The Ohio Open Records Law protects the right of citizens to see public records kept by the court, unless otherwise redacted by law. Records exist in the state from way back in the 1700s, but most modern records have been digitized and are available to view and search online.

Are Ohio Court Records Public? Court records are public and available to be inspected and obtained by the general public under the Open Records Law documented in Ohio Rev. Code § 149.43. The Ohio General Assembly first enacted this law in 1963, and it authorizes individuals to inspect and copy most documents and records filed in Ohio state courts. However, the general public’s right of access does not apply to every court record.

Public Records Complaint Process. The Ohio Court of Claims has jurisdiction to hear complaints alleging a denial of access to public records, pursuant to Ohio law (R.C. 2743.75). All public records cases are first referred to mediation with a court staff attorney or magistrate. If mediation is unsuccessful, a Special Master is assigned to review the case and issue a report and recommendation to a judge.

The Public Access Court Electronic Records (PACER) System contains docket sheet information on most criminal and civil cases that are unavailable through the CM/ECF System. A national District Court case and party index is also available through PACER. You must register with PACER to view cases not in the CM/ECF system. The charge per page is $.10.

That same statute provides a list of records that the Ohio legislature has specifically deemed not public records. In addition, the Courts in Ohio have also designated certain records as not public records. Despite these exceptions, the general rule in Ohio is that records kept by a public agency in the normal course of business are public records.
